1. What Valify is
Valify is a document review assistant for the UK construction industry. Valify analyses uploaded documents and produces a report identifying potential gaps, inconsistencies and missing information for review by your qualified health and safety personnel.
The document types covered depend on your plan. Starter covers RAMS documents only. Growth covers RAMS, Method Statements and Risk Assessments. Enterprise covers all document types agreed in your Enterprise agreement. Submitting a document type not covered by your plan may result in an incomplete or unsuitable analysis.
Valify is not a compliance certification service. Valify does not certify, approve, or sign off on any document, and using Valify does not constitute compliance with any health and safety law, regulation or standard. Reports produced by Valify cannot be used as proof of compliance to the Health and Safety Executive (HSE) or any other regulator.
2. No guarantee of completeness
While Valify is designed to identify common and structural gaps in documents, Valify does not guarantee that its review is complete or that every possible issue will be identified. Valify's output is provided as an aid to human review, not a substitute for it.
3. Client responsibility
All final decisions regarding the adequacy, completeness, and suitability of any document remain the sole responsibility of the client and its qualified health and safety personnel. Valify accepts no responsibility for decisions made or not made on the basis of a Valify report.
4. Acceptable use
You may not represent a Valify report as a professional safety assessment, compliance certification, or sign-off of any kind, or use a Valify report as proof of compliance to the HSE or any other regulatory body. You may not use Valify to process documents you do not have the right to submit.
5. Limitation of liability
To the maximum extent permitted by law, Valify's total liability to you arising out of or related to these Terms or your use of the service is capped at the total subscription fees paid by you in the one month preceding the event giving rise to the claim. Valify is not liable for any indirect, incidental, or consequential damages, including but not limited to project delays, fines, or losses arising from an incident on site.
Valify expressly excludes all liability for any accident, incident, injury, ill health, fatality, property damage, environmental harm, enforcement action, prosecution or claim of any kind occurring on site or otherwise, whether or not the document concerned was previously submitted to, reviewed by, or reported on by Valify, and whether or not Valify's report identified or failed to identify any related issue. Valify performs an automated review to assist human decision-making only; responsibility for the safety of any works, and for the adequacy of any document authorising those works, rests entirely with the client and its qualified health and safety personnel.
Nothing in these Terms excludes or limits liability for death or personal injury caused by Valify's own negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
6. Free trial terms
New accounts receive 3 free document scans, limited to one free trial per company. No payment details are required to start a free trial. Once all 3 free scans have been used, your account pauses until you select a paid plan.
7. Subscription, billing and cancellation
Starter and Growth plans are billed monthly or annually in advance. There are no setup fees on any plan.
Monthly plans may be cancelled at any time from your account settings. Cancellation takes effect at the end of the current billing month, and you retain access until that date. Part-months are not refunded.
Annual plans are paid upfront for a twelve-month term at a discounted rate equivalent to nine months of the monthly price. If you cancel an annual plan part-way through the term, the cancellation takes effect at the end of the paid twelve-month term. Annual plan fees are non-refundable and no pro-rata refund is given for unused months, except where a refund is required by law. You retain full access to the service for the remainder of the paid term.
Enterprise plans are billed annually under a separate agreement, and cancellation terms are as set out in that agreement.
8. Data retention
Uploaded documents and generated reports are stored for 90 days from the date of upload and then permanently deleted. See our Privacy Policy for full detail on data handling.
9. Third-party service providers
Valify is built on top of, and relies on, third-party service providers (sub-processors) to deliver the service: Supabase for authentication, database and document storage, OpenRouter to route document content to the AI model used for analysis, Stripe for payment processing, Resend for transactional email, and Vercel for website hosting. Your use of Valify is also subject to the acceptable-use terms of these providers where relevant. See our Privacy Policy for the full sub-processor list and how each one handles your data.
10. Governing law
These Terms are governed by the laws of England and Wales, and any disputes arising under them are subject to the exclusive jurisdiction of the courts of England and Wales.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated to active account holders by email before they take effect. Continued use of the service after that date constitutes acceptance of the updated Terms.
12. Age and authority
By accepting these Terms and creating an account, you confirm that you are 18 years of age or over, or that you are acting with the authority and supervision of an adult with legal capacity who is able to bind your organisation to these Terms.
You further confirm that you have the authority to enter into these Terms on behalf of the company or organisation named on the account, and that the organisation is bound by them. Where an account is created on behalf of an organisation, references to “you” in these Terms mean that organisation.
